The Toronto Star Photo Awards 2014 Rules

  1. Agreement: These rules govern the Toronto Star Photo Awards ("Contest"). The act of entering the Contest constitutes acceptance of the Contest rules and the decisions of the Contest judges, which decisions shall be final and binding upon all entrants.
  2. Sponsors: The Contest Sponsors are Toronto Star Newspaper Limited, Picturk and Canon Canada ("Sponsors").
  3. Eligibility: The Contest is open to all residents of Canada (except residents of Quebec) who are over 18 or have attained the age of majority in their province of residence, except for employees, their immediate families and anyone living with any employee of the Sponsors or their corporate affiliates, advertising or promotional agencies. Limit of twenty-seven (27) images per person can be entered with no more than three (3) images entered in each award category.
  4. Contest and Judging Criteria:
    1. To enter the Contest, photographs should be no smaller than 900 pixels on the shortest side and no greater than 2,400 pixels on the longest side. Some examples include:
      • 3:2 ratio landscape image, width 2,400 x height 1,600
      • 2:3 ratio portrait image, width 1,600 x height 2,400
      • 1:1 ratio square image, width 2,400 x 2,400
    2. An entrance fee is required to enter the Contest. The entrance fees are:
      • $10 One category
      • $18 Two categories
      • $24 Three categories
      • $30 Four categories
      • $36 Five categories
      • $42 Six categories
      • $46 Seven categories
      • $50 Eight categories
      • $54 All (nine) categories
    3. Categories: Judges are looking for photographers who demonstrate a keen eye, and images that have impact, originality, and creativity. Photographers will be able to enter photographs under nine different categories listed below. For a complete description of the categories click here

    4. Each entrant can enter a maximum of twenty-seven (27) images in the Contest and a maximum of three (3) images in each Contest category.
    5. The same image cannot be entered in more than one category. This includes altered and unaltered images.
    6. Entries must be uploaded online at http://thestar.picturk.com and include a valid email address.
    7. Contest begins on Saturday, March 29, 2014 at 12:01 a.m. EST and ends on Sunday, June 8, 2014 at 11:59 p.m. EDT. Entries must be received by Sunday, June 8, 2014 at 11:59 p.m. EDT. To be eligible, an entry must be the entrant’s original photo, may not have been entered in any other contest, won any other prize or have been previously published in any other medium. In connection with your submission, you affirm, represent and/or warrant that (i) you own or have the necessary licenses, rights, consents and permissions to use and authorize Sponsors to use all copyright, trademark or other proprietary rights in and to your submission to enable inclusion and use of the submission in the manner contemplated by these Contest rules; and (ii) you have the written consent, release and/or permission of each and every identifiable individual person in the submission to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of the submission in the matter contemplated by these Contest rules. Sponsors reserve the right to reject and disqualify any submissions that could be offensive or inappropriate or that do not meet the terms and conditions of these rules.
    8. The Contest is open to amateur photographers in Canada, excluding residents of Quebec. An amateur is a photographer who makes less than 15% of their annual income, or less than $3,500, whichever is lower, from the practice of photography.
    9. All imagery must be the total and exclusive work of the Entrant and may not include any element that is the copyright of another.
    10. Entrants may make reasonable use of digital darkroom type techniques which enhance quality but do not distort the photograph. Only minor burning, dodging and/or colour correction is acceptable, as is cropping. High dynamic range images (HDR) and stitches panorama are NOT acceptable. Any changes to the original Photograph not itemized here are unacceptable and will render the Photograph ineligible for a prize – the open and colour categories are exempt from this rule.
    11. When a photograph is submitted and entry finalized, the entry cannot be changed or edited.
  5. Judging and notification:
    1. Entries will be judged by the 2014 Toronto Star Photo Awards judging panel, who will select the Best Photograph prize, Best Photographer prize (based on the body of submitted work) and First prizewinner of each of nine (9) categories on or about Friday, June 20, 2014. The decisions of the contest judges are final in respect of any matter relating to this Contest.
    2. The potential winners will be contacted by telephone or email between 9:00 a.m. and 5:00 p.m. EST on or about Wednesday, June 25, 2014 by a representative of the Sponsors, and must reply within 48 hours to maintain eligibility. If the potential winner(s) cannot be contacted within this time period or fail(s) to respond to any attempted contact, such potential winner(s) will be disqualified, his/her entry will be declared null and void and the contest judgesreserve the right, in their sole and absolute discretion, to select another potential winner based on the judging criteria, in which event these provisions shall apply to such other eligible entry.
  6. Ownership/Use Rights: Entrants retain the copyright to their photographs. However, by entering the contest, you hereby grant the Sponsors a worldwide, irrevocable, perpetual, non-exclusive, royalty-free, sublicenseable and transferable license to print, publish, use, reproduce, distribute, prepare derivative works of your Contest entry, and display your full name and photograph in connection with your Contest entry, in any media formats and through any media channels.
  7. Prize: There will be 2 cash prizes. $1,300 will be awarded to Overall Winner and Star Photographer of the year. $1,300 will be awarded for the best photograph entered in the Awards.

    11. Winners may claim their Prize in Toronto, Ontario at the Toronto Star located at One Yonge Street, Toronto, ON, M5E 1E6 on or after Monday, July 7, 2014.
    12. If a winner selects not to pick up the Prize, the Prize will be shipped. Shipped Prizes will be shipped to the address indicated on each Winners’ Release and shall not be insured. The Sponsors shall not assume any liability for lost, damaged or misdirected Prizes.
    13. The winners’ photos will be published on thestar.com on Friday, June 27, 2014 and in the Saturday Star on Saturday, June 28, 2014. Should that date become unavailable due to unforeseen circumstances, the photos will run on the next available Saturday edition of the Toronto Star.
  8. Release: Prior to receiving the prize, the potential winner will be required to show valid photo ID and to sign a declaration of eligibility and release form releasing the Sponsors and their related parties from any and all liability in connection with the Contest and/or the prize, confirming compliance with the rules and consenting to the use of his or her name and photograph(s), in any and all forms of media, without further compensation, in any publicity carried out by the Sponsors and/or their advertising and promotional agencies.
  9. Indemnity: By participating in this Contest, you agree to defend, indemnify and hold harmless the Sponsors, and their parent, subsidiaries, affiliates and/or related companies and each of their officers, directors, shareholders, employees, advisors, assignees, agents, licensees, representatives, advertising, media buyers and promotional agencies from any and all damages, injuries, claims, causes of action, or losses of any kind (including but not limited to lawyers’ fees) arising from your participation in the Contest, your violation of any term of these Contest rules, your violation of any third party right, including without limitation any copyright, property, or privacy right; or any claim that your submission caused damage to a third party.
  10. Privacy: We use your personal contact information to administer contests, including contacting, announcing and promoting prizewinners. In addition, we may use this information to send you offers or information from us, our affiliates and from selected Sponsors or advertisers (“Marketing Offers”). If you do not wish to receive Marketing Offers, you may opt-out at any time by: following the instructions at the bottom of any email Marketing Offer you receive, informing your telemarketer at the time you are called with a Marketing Offer, calling 1.800.279.0181 and requesting that your personal information not be used for Marketing Offers, or emailing privacy@thestar.ca and requesting that your personal information not be used for Marketing Offers. The Contest is run in compliance with the Toronto Star Newspaper Limited privacy code, which may be found in full at www.thestar.com/privacy.
  11. Banning: The Sponsors may, in their sole discretion, prohibit any person from entering the Contest whom they believe to be abusing the rules. Such abuse includes entering false information.
  12. Other: This Contest is governed by the laws of Ontario and the laws of Canada applicable therein and is void where prohibited by law. The Sponsors reserve the right to cancel or modify the Contest or the Contest rules at any time without notice. All prizes must be accepted as awarded, are non-transferable and are not convertible to cash. The Sponsors reserve the right to substitute any prize or portion of the prize with a prize of equal or greater value. All prizes are awarded as-is and no warranties or guarantees are implied or expressed, beyond the standard manufacturer's warranty. Sponsors are not liable for any lost, late, misdirected or stolen entries or inability to process entries, or any errors, damage or negligence that may arise in connection with this Contest, including technical failures on the website or Contest software, viruses, website disruptions, malfunctions or website down-time, human error or property damage incurred by any Contest entrant. Sponsors are not responsible for any errors or omissions in printing or advertising this Contest. Use of any automated system including robotic or form filling software to enter or participate in this Contest is prohibited and will result in disqualification of all entries by anyone using such assistance. If a dispute arises regarding who submitted an online entry, the entry will be deemed to be submitted by the authorized account holder of the email address provided at time of entry. Authorized account holder is the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.
